Stadler lost the SBB tender for the framework contract for 200 double-decker trains to Siemens. Stadler found it difficult to understand this decision and therefore lodged an appeal with the Federal Administrative Court. The documents now handed over by the Federal Administrative Court are heavily redacted and have only partially restored transparency. It is clear, however, that SBB has clearly exercised its discretion in the evaluation in favour of Siemens.
By lodging the appeal, Stadler sought to secure an independent review by the Federal Administrative Court as an impartial body. Although Stadler gained some insight during the court proceedings, it did not achieve the full transparency it had hoped for. Numerous documents from the tender remained completely redacted. Consequently, passages relevant to the substance of the case and crucial evidence regarding the award decision remained inaccessible to Stadler.
It is, however, clear that SBB fully utilised its discretion in the evaluation of the bids in favour of the winning bid. This is evident from the court documents. SBB opted for a train model that had not yet been tested and was entirely new.
Stadler, by contrast, offered a double-decker train, 153 of which are proving their worth in daily service. This train is among the most reliable in the SBB fleet.
Due to the severely limited information available, Stadler has found no grounds to continue the legal proceedings and is therefore withdrawing its appeal as of 7 April 2026.
Chairman of the Board of Directors Peter Spuhler: "We continue to regret the decision, but must accept it on the basis of the information available to us. Stadler is focusing on continuing its long-standing and successful cooperation with SBB."
