The previous Heating Act will be repealed. This eliminates requirements that restricted the free choice of technology. The new law, by contrast, enables technological openness: In addition to heat pumps and district heating, biomass as well as gas- and oil-fired heating systems will remain permissible - provided they use increasing shares of climate-friendly fuels. The core instrument is the "bio staircase": From January 1, 2029, new oil and gas heating systems must use at least ten percent renewable fuels. In addition, a balance-based green gas and green heating oil quota for fuel distributors will start in 2028. The law is scheduled to enter into force before July 1, 2026. Biomethane is available, produced from regional agricultural residues, and can be supplied easily and cost-effectively to the point of consumption via the existing gas grid infrastructure. Cost advantage for consumers: CO₂ price eliminated The CO₂ price does not apply to the climate-friendly share of fuels. This simplifies calculations and strengthens the competitiveness of corresponding tariffs. The bio staircase and the green gas quota therefore combine climate protection with a fair price-performance ratio. Significantly greater potential The planned moderate green gas and green heating oil quota will gradually oblige distributors of natural gas and heating oil to use climate-friendly energy sources such as biomethane, hydrogen, bio-oil, and synthetic gases. The quota will start in 2028 at up to one percent, can be met on a balance-sheet basis, will be credited toward the bio staircase, and is intended to save at least two million tonnes of CO₂ by 2030. Industry and commerce are exempt. This regulation initiates the gradual integration of renewable gases into the heating market. The technically and economically feasible scope is significantly higher. A more ambitious quota or the broader inclusion of additional sectors would substantially increase its impact. Stefan Schreiber, Member of the Executive Board of Verbio SE and Chairman of the Green Gas Quota Initiative (GGQ), states: "With the current momentum, the Federal Government has the opportunity to anchor the green gas quota where it can unfold its full effect: in the Energy Industry Act (EnWG) and thus across the entire gas market. Depending on the detailed design, the use of biodiesel as a renewable fuel could also gain importance.
