TORONTO, Jan. 25 /CNW/ - Star Navigation Systems Group Ltd. (TSX: SNA-V) ("Star" or the "Company"), learned today that the U.S. Patent Office has granted Star's request to reconsider the patentability of AeroMechanical Services Ltd.'s (TSX: AMA-V) ("AMA") U.S. patent, U.S. 7,203,630. (See Star Press Release dated September 6, 2007).
The reexamination of AMA's patent was requested and granted by the USPTO based on Star's exclusively licensed U.S. Patent No. 7,113,852 (the "Kapadia Patent"), issued in the name of the inventors, including Viraf Kapadia, Star's Chairman and Co-CEO. Star has also sued AMA for patent infringement related to that patent in a recently filed lawsuit in the Northern District of California.
In ordering the reexamination of AMA's patent, the U.S. Patent Office recognized that the relevant merits and teachings of the Kapadia patent were not considered when the U.S. Patent Office issued AMA's patent. Thus, in ordering a reexamination of AMA's U.S. patent, the U.S. Patent Office confirmed that the Kapadia patent raised a substantial new question of patentability with respect to AMA's patent.
Star will continue to protect its intellectual property rights and is gratified that the U.S Patent Office has taken this position.
