Macdonald I'm writing to you in your capacity as counsel to the Court-appointed Monitor concerning a letter from Mr. Macdonald, counsel to the informal committee of convertible debenture holders. In his letter, the nature of which has been reported in the news media, Mr. Macdonald quotes me as having told the media that Justice Farley was intimately involved in the negotiations that led to the agreement on a restructuring plan announced on November 23, 2005. Mr. Macdonald goes on to suggest that Justice Farley should no longer preside over this file on the basis of a possible apprehension of bias or prejudgment resulting from this involvement. Allow me to set the record straight in this matter. The essence of what I actually told the media is this: While Justice Farley was, indeed, involved in the discussions among stakeholder groups, that involvement consisted of pressing the parties to come together and to reach an agreement. At no time did he participate in the actual negotiations between the parties. I do hope this places my reported comments to the media, and Mr. Macdonald's interpretation of those comments, in their proper context.
