Federal Court of Appeal decision released on Friends of Rockwood Park's application for leave to appeal

SAINT JOHN, Sept. 20 /CNW/ - Today, the Federal Court of Appeal heard the Friends of Rockwood Park (FORP) leave to appeal application related to the Brunswick Pipeline project.

Following the hearing, the Court dismissed the FORP application for leave to appeal the National Energy Board approval of the Brunswick Pipeline project and the related Certificate of Public Convenience and Necessity issued for the project.

"We are pleased with the outcome of today's hearing, and are continuing to develop the project toward a November 2007 construction start-up date and November 2008 in-service date," said Robin McAdam, president.

A separate application by FORP seeking a judicial review related to the NEB process is still pending direction from the court on the process for dealing with the matter.
