TORONTO, July 27 /CNW/ - ENPAR Technologies Inc. (TSX-V: ENP) ("ENPAR") wishes to report that a final award has been issued with respect to the Company's arbitration dispute with Biosource Inc. The arbitrator has issued an injunction which expressly permits ENPAR to develop and commercialize technology in competition with Biosource in the water-purification field as long as ENPAR does not use Patent Rights and Technical Information it was previously allowed to use under the Agreement.
The final award makes no determination regarding the validity or enforceability of Biosource's Patent Rights and nothing in the award should be construed to preclude ENPAR from challenging the validity of the Patent Rights or from asserting that it has not used Patent Rights to the extent such patents are invalid.
The term "Technical Information", that is referred to above, is limited to any research and development information, unpatented inventions, techniques, procedures, know-how, trade secrets, or technical data that was not otherwise publicly available and was provided by Biosource to ENPAR at any time prior to July 10, 2007, or has not become published and generally known to the public since July 10, 2007 through no fault or omission on the part of ENPAR.
