U.S. District Court declines Aeromechanical request to dismiss infringement lawsuit

About this update from Star Navigation Systems Group Ltd.

[{"type":"text","content":"\n\n\n\nTORONTO, April 10 /CNW/ - Yesterday, the United States District Court in\nSan Francisco, California declined Aeromechanical Services' (TSX: AMA-V)\nrequest to dismiss the patent infringement lawsuit filed by Star Navigation\n(Star).\n\n\nIn so ruling, the Judge identified a non-prejudicial technicality in the\ncase and requested the filing of an amended complaint to fully cure a\ntechnical jurisdictional defect. Star is in the process of preparing and\nfiling that amended complaint to resolve this procedural issue.\n\n\nAMS had argued that Star lacked the right to sue AMS and that the court\nhad no jurisdiction over AMS or its infringing activities. After considering\nAMS's lengthy arguments and Star's response, the Judge requested that the\ninventors of the patent at issue (U.S. 7,113,852, which is exclusively\nlicensed to Star) be included as plaintiffs in the law suit to help ensure\nthat all of AMS' patent infringement liability be identified in this\nlitigation.\n\n\nOriginally, the infringement suit was brought by Star only; however, the\ninventors, Messrs. Kapadia and Vieira, who had previously authorized the\nlitigation, will now be added as co-plaintiffs.\n\n\nThe patent infringement lawsuit is expected to continue following this\ntechnical correction.\n\n\nAbout Star Navigation.\n\n\nStar Navigation Systems Group Ltd. (www.star-navigation.com) owns the\nworldwide license to its proprietary, patented In-flight Safety Monitoring\nSystem - ISMS(TM), the first system in the world to feature in-flight\ndata-analysis, monitoring and diagnostics with a real-time connection between\naircraft and ground. Its real-time capability of tracking performance-trends\nand predicting incident-occurrence enhances aviation safety and improves fleet\nmanagement while reducing costs for the operator.\n\n\nCertain statements contained in this News Release constitute\nforward-looking statements.
