The Bill would require the Food and Drug Administration (FDA) to develop regulations for food and beverages containing hemp-derived CBD and allow for their interstate commerce. This is a huge development in the hemp industry that will be beneficial to consumers. Ever since hemp and its derivatives were declared federally legal under the 2018 Farm Bill, the industry has been waiting for clear rules and regulations with regard to food and beverages infused with hemp-derived CBD.  Sponsored by Reps. Kathleen Rice (D-NY), Morgan Griffith (R-VA), Angie Craig (D-MN) and Dan Crenshaw (R-TX), the CBD Product Safety and Standardization Act would “help address a regulatory gap that hemp stakeholders have been pushing FDA to resolve.” Representative Kathleen Rice (D-NY) noted recently that CBD products were exploding in popularity, but the lack of federal regulation surrounding them has put consumers at risk and left businesses looking for clarity. The bipartisan CBD Product Safety and Standardization Act of 2021 will establish the clear regulatory framework needed to provide stability for businesses that sell hemp-derived CBD foods and beverages and ensure unsafe products stay off the shelves in order to ensure consumer safety. Current FDA regulations do not reflect the new reality of how much hemp-derived foods have surged and as a result, “adulterated or unsafe products are available that threaten consumer health”.
