Update re Austrian Court Decision to Issue Interim Injunction in Favour of Cymat's Patent

TORONTO, May 9 /CNW/ - As previously disclosed, during the second quarter
of fiscal 2005 Cymat initiated infringement proceedings against an Austrian
company and sought an interim injunction to prevent it from further infringing
Cymat's patented metal foam production process.
As also previously disclosed, during the third quarter of fiscal 2005 the
Commercial Court of Vienna (the "Court") confirmed its decision to issue the
interim injunction against the Austrian company. Once issued, the injunction
prevents the Austrian company from practicing Cymat's aluminum foam process
and from selling, offering for sale, using and /or possessing aluminum foam
products manufactured according to such process until the Court renders its
final decision regarding the infringement suit.
During the fourth quarter of fiscal 2005 the Court formally issued the
interim injunction against the Austrian company after Cymat posted the
required security bond of (euro) 1,000,000 (approx. $1,600,000). As expected,
the Austrian company has exercised its right of appeal. Cymat has filed its
response and the appeal is being considered.
Cymat will continue to vigorously employ all legal remedies to enforce
its patents.
