(\"Constellation\")\n(TSX: CSU) announced today that on September 19, 2006, the U.S. District Court\nfor the District of New Jersey issued an opinion and order in the matter of\nA.D.M. Club Management Systems, Inc. v. Gary Jonas Computing, Ltd., Civ. No.\n05-3943 (HAA), dismissing all claims brought by four former independent sales\nrepresentatives of Jonas software against Gary Jonas Computing, Ltd. and CSI\nUSA Distribution, Inc. (each a wholly-owned subsidiary of Constellation). The\ncourt dismissed with prejudice the antitrust claim asserted by all of the\nsales representatives on the basis that the sales representatives had not\nsuffered an antitrust injury and, therefore, lacked standing to bring an\nantitrust claim. As to two of the sales representatives, whose written\nagreements contained forum selection clauses specifying the Courts of Ontario,\nCanada as the mandatory forum for resolving disputes, the court dismissed\ntheir non-antitrust claims without prejudice to being brought in the agreed\nforum. The claims of the two remaining sales representatives were dismissed,\nwithout prejudice, because the court found that New Jersey was an improper\nvenue for resolution of their claims.
