Tambang Mas Sangihe\n \n \n (\n \n \n TSXV:BARU\n \n \n )\n \n \n |\n \n \n (\n \n \n OTC: BARUF\n \n \n )\n \n \n (\"TMS\")\nor the \"Company\") is delighted to inform stakeholders and\ninvestors that the Company's work on Sangihe has received the National\nVital Object designation. We are also announcing the withdrawal of the\nlawsuit filed by the Company, announced on August 25, 2022.\n \n \n \n \n The Company holds a Contract of Work with the\nGovernment of Indonesia that provides the legal right to explore,\nconstruct, and produce gold on the Island of Sangihe. The Government\nof Indonesia must uphold the terms of the Contract. In August of 2022,\nthe Company filed a lawsuit to resolve issues preventing the\nfulfillment of the Contract of Work's terms.\n \n \n \n \n The objective of the court filing was to pursue\nfinancial damages or, preferably, appropriately support the Company\nand their contractual rights to mine gold on Sangihe Island. The\nlawsuit named the President of the Republic of Indonesia and national\nheads of government agencies, along with alleged illegal miners and\ntheir supporters in the Sangihe Police and local government.\n \n \n \n \n The lawsuit praises President Joko and appeals for\nsupport in resolving documented issues created by his subordinates.\nMany of the individuals named in the lawsuit were operating for\npersonal enrichment and actively interfering with or failing to\nsupport the Company. A key issue raised by the Company was local\ngovernment officials and police refusing to protect Company staff and\nequipment while overtly supporting illegal mining. Without question,\nthe refusal by the Sangihe Police to enforce the rule of law prevented\nthe Company from entering production status.\n \n \n \n \n The Company now believes the issues raised in the\nlawsuit are no longer present and has withdrawn the lawsuit.\n \n \n \n \n The Company notes that President Joko explicitly\nacknowledged the harm of illegal mining and has ordered branches of\nthe military and police to stop the practice.
