This decision removes the potential regulatory burden that would have been placed on the industry if BPL had been classified as a telecommunications service, and puts BPL in the same category as DSL and cable modem technologies. A company spokesman noted, \"A high regulatory burden, or even the threat of such a burden, can slow the development and implementation of new technology as companies wait to see what regulations will be imposed and what it will cost to comply with them. This decision defines the playing field and allows the industry to move forward. Ultimately, we believe it will provide consumers with more services and more choices of information services, especially in markets currently underserved by DSL and cable modem.\"\r\n\r\nThe FCC had previously ordered that BPL providers could not interfere with existing radio services (i.e. could not cause harmful interference). Taken together, that decision along with the new classification clears the way for the introduction of BPL and other PLC systems while still requiring that those systems be introduced responsibly and free from harmful interference. A company spokesman further stated, \"Back when most providers or potential providers of BPL service were asking the FCC for a relaxation of interference requirements, APT stated its belief that the technology could and should meet the interference requirements imposed on other technologies. We conducted tests of our technology verified by an independent third-party and posted the results of those tests publicly on our web site. Our July 2, 2004 comment to the FCC recommended that PLC and BPL be held to the same interference standards as other technologies and that BPL be classified in the same category with DSL and cable modem systems.
